Conversion and repurposing

Converting a vacant office or retail building into housing sounds attractive, but it involves more construction work and legal complexity than a standard renovation. You are giving the building a new function - this is what we call conversion or change of use. In this article you will read what that means for the permit, which construction requirements apply to the new residential function and how the process with the municipality works.

Short answer

Converting an office, shop or commercial building into housing almost always requires a permit, even without major building work: the change of use itself requires an environmental permit. What is conversion or change of use?

Conversion means giving a building a different function than the one it was originally built or permitted for. An office becomes an apartment complex, a retail unit becomes a home or an industrial hall becomes a residential building. The terms conversion and change of use are often used interchangeably; in practice they mean the same thing: a change of use of an existing building.

This is different from a regular renovation where the function remains the same. If you renovate an office while it remains an office, it is an internal modification. As soon as you change the use to residential, the rules change fundamentally.

Why is conversion popular? Vacancy of office and retail premises is a major problem in the Netherlands, while there is a significant housing shortage. Municipalities therefore often actively encourage conversion. However, the project is not without its challenges: the construction requirements for a residential function are considerably higher than for an office or shop, and you need the environment plan and the permit on your side.

Is a permit required for conversion?

Yes, a change of use is almost always subject to a permit requirement. You need at least an environmental permit for the component building and use. Conversion touches two assessment frameworks side by side:

1. The environment plan (formerly the zoning plan). The municipality determines in the environment plan which use is permitted at a location. A former office building generally has the function 'office' or 'business'. Residential is a different function. Only when the residential function fits within the environment plan or when the municipality is willing to grant an exception (formerly 'deviation from the zoning plan') can the conversion be realised.

Whether residential use fits your location can be checked via the Omgevingsloket (omgevingsloket.nl) or by consulting your municipality's environment plan. In many municipalities, inner-city locations with vacant offices have also been designated for housing programmes, which increases the likelihood of approval. However, the municipality has policy discretion here; a conversion that does not fit within the plan requires a more extensive procedure.

2. Structural requirements of the Decree on construction works in the living environment (Bbl). In addition to the planning assessment, the building must meet the requirements that the Bbl sets for a residential function. These are stricter requirements than for an office or retail unit. You can read more about this in the next section.

Please note: even if you make no major structural alterations, changing the use is already an action that requires a permit. You can never simply allow people to live in a building that was permitted as an office, even if you make no changes to it.

Technical construction requirements for residential use (Bbl)

When a building changes function to residential use, the municipality tests it against the new-build requirements of the Bbl for existing buildings or, depending on the scale of the renovation, against the renovation requirement. The exact standards depend on the situation, but the following themes are relevant in every conversion:

Daylight and outdoor air. Dwellings must have sufficient daylight. An office with small or high windows or even a facade without windows often does not meet this requirement. This may mean breaking open the facade, enlarging windows or installing new roof windows. A permit is again required for this.

Ventilation. A residential property requires different ventilation provisions than an office. Mechanical ventilation or a balanced ventilation system is common in newer conversion projects. The requirement is aimed at air quality and the prevention of moisture and mould.

Fire safety and escape routes. Residential uses place different demands on fire compartmentation, fire detection and escape routes than offices or shops. Especially in an apartment building, escape stairs, emergency exits and fire-resistant partition walls must meet residential use requirements. Additional interventions in the structure and layout are often necessary.

Sound insulation. Dwellings must comply with sound requirements between rooms (airborne and impact sound) and in relation to the facade (environmental noise). In a former office or retail building on a busy street, the facade insulation is often insufficient. Additional facade insulation is then necessary.

Structure. A residential use has different load patterns than an office. Residential floors partly have higher requirements for floor loads than office floors, but the biggest structural challenge is often in modifying the floor plan: adding or removing walls, installing bathrooms and kitchens and laying pipes and utilities. Structural interventions almost always require a structural calculation.

Energy performance. Conversion projects fall under a transitional regime for energy performance, but the Bbl still sets minimum requirements here too. Additional facade insulation, roof insulation, or floor insulation is often already required for fire safety or sound reasons, and then ties in with the energy targets.

Because the requirements vary greatly per situation (type of building, year of construction, municipality, scale of the project), it is wise to involve a drawing office early in the process that makes the drawings and tests the feasibility together with a structural engineer.

The process: from idea to permit

A conversion runs through multiple steps. Here is the sequence you follow in practice:

Step 1: Check function possibilities. Check via the Omgevingsloket whether residential use is planologically possible at your location. If necessary, ask the municipality whether there is an active policy for conversion or whether you need to go through a more extensive procedure.

Step 2: Feasibility check. Have a drawing office and a structural engineer assess the existing situation. Which structural modifications are needed to meet the Bbl requirements for residential use? What are the consequences for the facade, the structure and the installations? This prevents you from applying for a permit for a plan that is not structurally feasible.

Step 3: Pre-consultation with the municipality. For conversions a pre-consultation (also known as a principle request or pre-application) with the municipality is strongly recommended. You present the plan, the municipality indicates whether it will cooperate with the change of use and what additional requirements it will impose. This prevents surprises later in the formal procedure.

Step 4: Have construction drawings made. A drawing firm records the existing situation and draws up the new situation: floor plans, facades, cross-sections and a site drawing. The drawings must clearly show the existing and new situation and demonstrate that the design meets the requirements for a residential function. Points of attention and pitfalls

Conversion is a more extensive project than a standard renovation. A number of pitfalls you want to avoid:

Planning mismatch. The most common reason conversions run into delays is that residential use does not simply fit within the environment plan. Check this as the very first step, not only after the drawings have been made.

Underestimating building technical requirements. Many owners think a building can quickly be converted to dwellings. In practice, daylight, ventilation, fire safety and sound often require far-reaching modifications. A feasibility check in advance prevents costly surprises.

Parking. With a change of use the municipality also considers the parking requirement. An office has different parking standards than dwellings. If there are insufficient parking spaces for the project, the municipality may refuse the permit or impose additional requirements. Incorporate the municipal parking requirement early in the design.

Soil and environment. Former commercial buildings may be affected by soil contamination or environmental load (noise, hazardous substances). When converting to residential use, the environmental aspect is assessed more rigorously. A soil survey is often a mandatory part of the application when converting commercial buildings.

Stacking environmental permit activities. A conversion application typically covers multiple activities at once: building, change of use and sometimes also a deviation from the environment plan. Make sure the application covers all these activities; missing activities can lead to an incomplete application and delays.
