Environmental permit fees

When you apply for an environmental permit, you pay two very different bills: one to the drawing office for the construction drawings and one to the municipality for processing your application. That second bill is called municipal fees. Many people are surprised by this, because it is rarely clearly stated on a quote. In this article we explain what municipal fees are, how municipalities calculate them and why the amount varies so greatly from one municipality to another.

Short answer

Municipal fees (leges) are the charges a municipality levies for processing your environmental permit application, separate from drafting costs. Most municipalities charge a percentage of the estimated construction sum: at a rate of 2% and a construction sum of €80,000, you pay €1,600. There is no national standard rate; percentages range from under 1% to over 3%. You pay as soon as the application is taken into processing, even if it is refused, although many municipalities then refund 25 to 50%.

What exactly are municipal fees?

Municipal fees are the charge a municipality levies for processing your environmental permit application. They are municipal costs for the official assessment: a staff member from the permits department reviews your application, checks the drawings against the Bbl and the municipal environment plan, and makes a decision. The municipality passes on the cost of that work to the applicant.

Municipal fees are legally regulated through the Municipalities Act. Each municipality sets its own fees ordinance, including the rates. This means there is no national standard rate. The municipality of Amsterdam charges different amounts than a smaller municipality in Drenthe, even for exactly the same dormer window.

Leges zijn GEEN tekenkosten. Dit is het meest voorkomende misverstand. Een tekenbureau zoals Tekenpunt rekent voor het opstellen van de bouwtekeningen, plattegronden, gevelaanzichten en situatietekeningen. How does the municipality calculate the municipal fees?

Most municipalities calculate municipal fees as a percentage of the estimated construction cost. That is the estimated contract sum for the building works, so not the costs for the drawing work, the permit itself or the VAT on the municipal fees.

Voorbeeld: een aanbouw met een bouwsom van €80.000 leidt in een gemeente met een legestarief van 2% tot €1.600 aan gemeentelijke leges. Een andere gemeente met een tarief van 1,5% rekent voor diezelfde aanbouw €1.200.

Municipalities often work with scales or brackets, where the percentage decreases as the construction cost increases. Some municipalities also apply fixed minimum amounts for smaller applications, regardless of the construction cost. The exact structure differs per municipality and is set out in the municipal fees by-law, which you can request or find on the municipal website.

Wat telt mee als bouwsom? Gemeenten vragen doorgaans de aanneemsom exclusief btw, exclusief grondkosten en exclusief bijkomende kosten als leges en tekenbureaukosten. Bij grotere projecten of als er twijfel is over de opgegeven bouwsom, kan de gemeente een eigen raming maken op basis van kengetallen per type bouwwerk. Aparte tarieven voor welstand. In gemeenten waar een welstandscommissie de aanvraag beoordeelt, kan de gemeente een aparte legesheffing rekenen voor de welstandstoets. How much do you pay in municipal fees? What is a realistic amount?

There is no national standard amount and it would be incorrect to name a fixed national figure. The level of the municipal fees depends on two variables: the construction cost of your project and the rate your municipality applies.

As a rough guide: for smaller interventions such as a dormer or a storage building, the municipal fee bill can amount to a few hundred euros. For a medium-sized extension with a construction cost in the order of €50,000 to €100,000, you will find that in many municipalities the fee bill comes to €500 to €2,500. For larger projects, that can rise to several thousand euros.

Hoe vind je het exacte bedrag voor jouw gemeente? Er zijn drie manieren:

  1. Legesverordening opzoeken. Zoek op de website van jouw gemeente naar 'legesverordening' of 'legestarieven omgevingsvergunning'. Hierin vind je de exacte tariefstructuur voor dit jaar.
  2. Omgevingsloket. Via omgevingsloket.nl kun je een vergunningscheck doen en in sommige gevallen een indicatie van de leges opvragen.
  3. Bellen met de gemeente. De afdeling vergunningen of Omgevingszaken van je gemeente kan je de actuele tarieven geven en uitleggen hoe ze worden berekend voor jouw type aanvraag.

When do you pay municipal fees and what if the permit is refused?

Wanneer worden leges in rekening gebracht? Gemeenten brengen leges in rekening op het moment dat je aanvraag in behandeling wordt genomen. Dat is kort na indiening. Je ontvangt dan een factuur of acceptgiro van de gemeente. Je betaalt dus de behandelingskosten, niet pas bij verlening van de vergunning.

Betaal je ook leges als de vergunning wordt geweigerd? Ja, in principe wel. Leges zijn een vergoeding voor het behandelingsproces, niet voor de vergunning zelf. De gemeente heeft werk verricht, ook als de uitkomst een weigering is.

Deels terugkrijgen bij weigering. In veel gemeenten is er bij een weigering een regeling voor gedeeltelijke teruggave van de leges. Dat kan gaan om 25% tot 50% van de geheven leges, afhankelijk van de legesverordening van jouw gemeente. Dit is niet universeel geregeld en verschilt per gemeente. Controleer dit in de legesverordening of vraag het na bij de gemeente voor je indient.

Bij intrekking van de aanvraag. Trek je de aanvraag in voordat de gemeente een besluit heeft genomen, dan is er in sommige gevallen ook een regeling voor gedeeltelijke restitutie. Hoe vroeg je intrekt speelt daarbij een rol: hoe eerder, hoe groter de kans op een hogere teruggave.

Wat als je aanvraag buiten behandeling wordt gesteld? Een incomplete aanvraag wordt door de gemeente niet in behandeling genomen. In dat geval worden de leges niet of slechts gedeeltelijk in rekening gebracht, afhankelijk van hoe ver de gemeente is gegaan. Dit benadrukt het belang van een volledige en correcte aanvraag. What is and what is not subject to municipal fees?

Municipal fees cover only the municipality's processing costs. They cover the municipality's assessment work: checking against the Bbl, reviewing the environment plan, any aesthetic review, and issuing the decision. Sometimes the advisory costs of an external party engaged by the municipality (such as a fire safety advisor or structural advisor) are also included in the municipal fees.

Wat valt NIET onder leges:

  • De kosten voor het laten opstellen van de bouwtekeningen. Dat zijn tekenkosten, betaald aan het tekenbureau. Bij Tekenpunt begint een bouwtekening voor een vergunningsaanvraag vanaf €595.
  • De kosten voor een constructieberekening. Dat is een aparte post die je betaalt aan de constructeur of het tekenbureau dat de berekening opstelt. Tekenpunt biedt dit aan voor €700 via een KIWA-gecertificeerd constructeur uit het eigen team.
  • De add-on voor het indienen en begeleiden van de omgevingsvergunning. Tekenpunt rekent hiervoor €500 als aanvullende dienst bovenop de tekeningen: dat is de begeleiding en indiening door het bureau, niet de gemeentelijke heffing.
  • Btw over de leges: leges zijn vrijgesteld van btw. De rekening van de gemeente is btw-vrij. De factuur van Tekenpunt is dat niet.
  • Bouwkosten, aanneemkosten of andere uitvoeringskosten.

A good budget for a permitted renovation therefore always consists of at least three separate items: drawing costs, municipal fees and construction costs. Each is invoiced by a different party.

Municipal fees and the Environment Act: what has changed?

Since 1 January 2024 the Environment Act applies. It replaces a large part of the former legislation, including the Wabo. The application is now called an environmental permit (it already was), but the assessment now takes place against the Besluit bouwwerken leefomgeving (Bbl) and the municipal environment plan instead of the former Building Decree and zoning plan.

Wat verandert er voor de leges? In de kern is de legesstructuur hetzelfde gebleven: gemeenten stellen zelf hun tarieven vast via een legesverordening en berekenen die op basis van de bouwsom. Wat wel verandert is dat het omgevingsplan gemeenten meer ruimte geeft om eigen regels te stellen voor ruimtelijke kwaliteit. Dat kan betekenen dat bepaalde aanvragen zwaarder worden beoordeeld, wat in sommige gevallen ook doorwerkt in de legesstructuur.

Reguliere procedure. De meeste aanvragen voor een aanbouw, dakkapel of uitbouw vallen onder de reguliere procedure: de gemeente heeft maximaal 8 weken de tijd om een besluit te nemen, met een mogelijke verlenging van 6 weken. Leges worden berekend ongeacht of de procedure vlot loopt of verlenging nodig heeft.

Vergunningvrij bouwen. Niet elke verbouwing is vergunningplichtig. Sommige kleinere bouwwerken zijn vergunningvrij onder het Bbl als ze aan specifieke voorwaarden voldoen voor maatvoering, ligging en gebruik. Vergunningvrije bouwwerken hebben ook geen leges: als je geen aanvraag indient, zijn er geen behandelkosten. No. Municipal fees are the costs the municipality charges for processing your environmental permit application. The costs for a construction drawing you pay to the drawing office, separately from the municipal fees. The two items are entirely independent of each other and are invoiced separately.

Q02How much in municipal fees do I pay to my municipality?

This depends on two things: the construction cost of your project and the municipal fees rate of your municipality. Municipalities set their own rates and there is no national standard. Not fully. Municipal fees are compensation for the processing procedure, not for the permit itself. In many municipalities there is a partial refund arrangement on refusal, but this varies per municipality. Check the fees ordinance of your municipality or enquire before you submit.

Q04When do I have to pay the municipal fees?

The municipality charges municipal fees at the moment the application is taken into processing, shortly after submission. You then receive an invoice or payment request from the municipality. You do not need to wait for the permit to be granted.

Q05Are the municipal fees included with Tekenpunt?

Q07Do I pay municipal fees even if my renovation is permit-free?

No. If a renovation is permit-free under the Buildings and Living Environment Decree (Bbl) and you do not submit an application, there are also no municipal fees.
